Terms governing the use of our services

Law

These terms and conditions shall be governed and construed in accordance with English law. English Courts shall have jurisdiction in relation to any matters arising in connection with any contract between HistoPIC, its owner or owners and the customer into which these terms are incorporated.

Licence and Website Access

We grant you a limited, revocable licence to access and make personal use of the website as our customer. However, you are not permitted to:

  • Reproduce, duplicate, copy, sell or otherwise exploit the website or any product image, product listing, product description, price, page layout, page design, trade dress, trademark, logo or other content ("Website Content") for any commercial purpose, except as expressly provided. You may copy the descriptive content and written information for personal, educational or research use, but if you do so you must acknowledge its source. In addition you must not alter the context or otherwise mislead with your use of the information
  • use a robot, screen scraper, spider or data mining or extraction tool or process to monitor, extract or copy Website Content (except in the operation or use of internet "search engines," hit counters or similar technology)
  • use any meta tags, search terms, key terms, or the like that contain the website's name or trademarks used on the website
  • engage in any activity that interferes with the website or another user’s ability to use the website
  • modify, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the website and the services offered on the website; or assist or encourage any third party in engaging in any activity prohibited by these Terms of Use
  • Any use of the website or Website Content that is not expressly authorised herein is prohibited and immediately terminates the licence granted herein.

Terms of Sale

Terms of Sale apply to all offers made by HistoPIC, its owner or owners and all orders placed by you and all agreements concluded between us in relation to the products and services offered on this website.

Pricing

Price Variation

Price includes third party partner printing costs of production and is subject to amendment, where such amendment is required in order to meet any rise or fall in such costs.

Delivery & Payment

Customers using our service will make payment in advance by PAYPAL. Card holder information is held by the third party and not HistoPIC.

Product Descriptions

We attempt to describe our products offered as accurately as possible. However, we do not warrant that product descriptions or other content of the website are 100% accurate, complete, reliable, current or error-free. If a product offered by us and purchased by you is not as described, your sole remedy is to return it in unused condition for a conforming replacement, refund or credit.

Acceptance of Order

We reserve the right to refuse or cancel any order. In such event your sole recourse shall be the return of amounts paid by you related to such order (if any).

Return Rights and Instructions

The quality of your experience is our priority. In the event that you are not satisfied with any item, you many return it within 30 days of receipt for a replacement or refund for the price of the product. Shipping charges will not be refunded. If your order was damaged during delivery (or other quality concerns), we invite you to return it for a full refund (minus shipping charges) by following these simple steps:

Ship your item back to us in its original packaging and enclose your completed return request (the shipping address is listed at the bottom of the form). We strongly encourage you to return the item via a trackable method.

We will typically issue your refund within 48-72 hours of receiving the package.

Disclaimer

We are not liable for any financial damage (including but not limited to the cost of any replacement purchase) that may occur because of non-timely arrival or any lack of availability or conformity of the product.

Claims

Advice of damage, delay or partial loss of goods in transit or of non-delivery must be given in writing to HistoPIC and the carrier within three clear days of delivery (or, in the case of non-delivery within 28 days of despatch of the goods) and any claim in respect thereof must be made in writing to HistoPIC and the carrier within seven clear days of delivery (or, in the case of non-delivery, within 42 days of despatch). All other claims must be made in writing within 28 days of delivery. HistoPIC shall not be liable in respect of any claim unless the aforementioned requirements have been complied with except in any particular case where the customer proves that (i) it was not possible to comply with the requirements and (ii) advice (where required) was given and the claim made as soon as reasonably possible.

Liability

HistoPIC gives no warranties or guarantees of any completed work the subject of a customer’s order and all other warranties, conditions, guarantees or representations, whether express or implied, oral or in writing, except as expressly stated in these terms and conditions are hereby excluded. HistoPIC shall not be liable for any loss arising from delay in transit not caused by HistoPIC or their third party printing partner. Nothing in these terms and conditions shall be construed so as to limit or exclude liability which cannot, pursuant to English Law, be excluded or limited including for death or personal injury or liability in respect of fraud or fraudulent misrepresentation.

Force Majeure

HistoPIC shall be under no liability if it shall be unable to perform any obligation which is owed by it to the customer for any reason beyond his control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by third party partner employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the customer may by written notice elect to terminate the contract, but subject thereto shall otherwise accept delivery when available.
